After an arrest, one of the first questions is how to get out of jail. In Arkansas, a judge decides release conditions, often at a first appearance or bail hearing. Here is what the judge considers.
Release Without Money Bail
Arkansas’s rules favor release without money bail when other conditions will work. A judge should set money bail only after deciding that no other conditions will reasonably make sure the defendant comes to court (Ark. R. Crim. P. 9.2).
Factors in a Bail Hearing
When setting bail, the judge looks at the risk that the person will not appear. Under Rule 9.2, the factors include:
- How long the person has lived in the community
- Employment history and financial condition
- Family ties
- Reputation, character and mental condition
- Past record of showing up to court
- Prior criminal record, including any history of violence
- People in the community who will vouch for the person
- The nature of the charge and the likely sentence, as they relate to the risk of not appearing, danger to others, or interference with witnesses
Types of Bond
The rules allow several forms of bond. For example, a judge may allow an unsecured bond, a bond with a 10% cash deposit, or a fully secured bond.
Follow Every Condition
Release often comes with conditions, such as no contact with certain people. Violating a condition can lead to arrest and a higher bond. So follow every condition exactly.
How a Lawyer Can Help at a Bail Hearing
A lawyer can present facts about your ties to the community and ask the court to reconsider bail. For more, see my criminal defense page.
